1. Scope and acceptance

These terms and conditions ("Terms") apply to all coaching, consulting and related services offered by Sebastian Buurma, operating as a sole trader (eenmanszaak) under his own name — Sebastian Buurma is also the trade name — registered with the Dutch Chamber of Commerce (KvK) under number 42028086, established in Amersfoort ("Sebastian", "I", "me"), to any person or organisation that books, discusses or receives a service via sebastianbuurma.nl, by email, WhatsApp or in person ("Client", "you").

By booking a session or package, or by continuing to use a service after these Terms have been shared with you, you accept these Terms. For a new Client, Sebastian shares these Terms before the first paid session so they can be agreed in advance.

These Terms take priority over any terms a Client may try to apply, unless agreed otherwise in writing.

2. Services

Sebastian offers sport and performance psychology coaching for race drivers, including one-on-one sessions, monthly guidance packages, and active or remote support on testing days or race weekends ("Services"). Where relevant, Sebastian also involves the driver's direct team in this guidance.

Descriptions of the Services on sebastianbuurma.nl describe Sebastian's way of working, not a promised outcome. Sebastian does not guarantee any specific competition result, selection, contract, or career outcome — performance psychology supports a driver's development, but on-track results also depend on factors outside Sebastian's control (car, team, competition, and the driver's own performance on the day).

An engagement for paid Services exists once Sebastian and the Client have agreed on scope and rate, whether by email, WhatsApp message, or in person — a quote or description on the website is not itself a binding offer.

3. Third parties

To run the Services, Sebastian uses a small number of third-party tools:

Sebastian does not use these tools' data for any purpose beyond delivering and administering the Services, or running his own business (such as drafting documents or managing the website). See the Privacy Policy for how each tool, including Claude, is used.

4. Rates and payment

Rates are shown in euros on sebastianbuurma.nl (currently €130 per hour, ex. VAT, excluding travel and related expenses) and may be changed by Sebastian at any time; a rate already agreed with a Client for an ongoing package is not affected.

Invoices are sent via Moneybird and are due within 14 days of the invoice date, unless agreed otherwise. If payment is not received on time, the Client is in default without a separate reminder being required, and Sebastian may charge statutory interest and reasonable collection costs, and may suspend further sessions until outstanding invoices are paid.

5. Cancellation and rescheduling

A Client may reschedule or cancel a confirmed session free of charge up to 24 hours before the agreed time. A session cancelled later, or missed without notice, may be charged at the full rate, except where Sebastian agrees otherwise (e.g. illness, a last-minute change to a race schedule).

6. Right of withdrawal

If a Client books a Service as a consumer (not as a business) and the booking is made at a distance (e.g. by email or through the website, without meeting in person first), the Client has the right to cancel within 14 days of booking, without giving a reason, as long as the Service has not yet started at the Client's request.

If a Client explicitly asks Sebastian to begin a Service within that 14-day period, the right to cancel ends once the Service has been fully delivered, and the Client owes a proportional amount for any part already delivered if they cancel partway through.

To cancel, the Client emails sebastian@sebastianbuurma.nl within the 14-day period.

7. Minors

Many of Sebastian's clients are junior drivers under the age of 18. For a Client under 18:

• A parent or legal guardian must agree to the Services before coaching starts, and is included from the first contact onward (for example, copied on key emails, or part of the initial WhatsApp or video call).
• The parent or guardian is responsible for payment, for agreeing to these Terms on the driver's behalf, and for exercising any right of cancellation.
• Sebastian may still correspond directly with the young driver day-to-day (e.g. scheduling a session), but any decision about the engagement itself (starting, changing, or ending it) is made together with the parent or guardian.

8. Confidentiality and professional conduct

Sebastian treats everything a Client (or, for a minor, their parent/guardian) shares in the course of the Services as confidential, and does not share it with the driver's team, sponsors, or anyone else without the Client's permission — except:

• where Sebastian is legally required to disclose it (for example, a court order, or a genuine safety concern);
• information that is already public, or that the Client has shared publicly themselves.

The Client also keeps confidential any non-public information they receive from Sebastian (methods, materials, pricing). Either party may be liable for damages if they breach this confidentiality obligation.

9. Intellectual property

Any materials, exercises, frameworks, or documents Sebastian provides as part of the Services remain Sebastian's intellectual property (or that of his licensors). The Client receives a personal, non-exclusive right to use them for their own development — they may not be copied, resold, or shared with third parties (including other drivers, coaches, or teams) without Sebastian's written permission.

10. Liability

Sebastian is only liable for damage caused by intent or gross negligence in delivering the Services. Sebastian is not liable for indirect damage (including lost results, lost sponsorship, or lost opportunities), and never guarantees a particular competition outcome.

If Sebastian is liable, that liability is limited to the amount paid out under Sebastian's professional liability insurance for that event, or, if no payout is made, to the amount the Client paid for the Services in the 12 months before the event giving rise to the claim.

A Client's claim for damages lapses 12 months after the event that caused it, unless the Client has already started legal proceedings within that period.

11. Complaints

A Client with a complaint about the Services should first raise it directly with Sebastian by email at sebastian@sebastianbuurma.nl, describing the issue as specifically and promptly as possible. Sebastian aims to respond within 14 days.

12. Force majeure

Sebastian is not liable for delay or failure to deliver the Services caused by circumstances beyond reasonable control, such as illness, accident, strikes, government measures, or failures of internet, power, or the tools listed in Section 3. Affected obligations are suspended for as long as the circumstance lasts.

13. Changes to these terms

Sebastian may update these Terms from time to time, for example to reflect a change in services, rates, or tools used. The current version is always the one published on sebastianbuurma.nl, dated at the top of this page. Where a change materially affects an ongoing Client, Sebastian will let them know in advance where reasonably possible.

14. Governing law and competent court

Dutch law applies to these Terms and to any agreement between Sebastian and a Client. Any dispute that cannot be resolved directly is submitted to the competent court in the district where Sebastian is established (Amersfoort).
